The
evolution of mobile music as we can see has brought us into a new level of
development in technology. From the beginning, the emergence of the first
mobile music known as Walkman has completely change the way people listened to
music. We could listen to our favorite songs whenever we wanted anywhere.
Started with tapes/cassettes and later on, changed into CDs where the features
of the mobile music also change to a new identity, known as the Discman. It
became a trend during that time where those who possessed the Discman will be
associated with stylish and modern lifestyle. Years later, MP3 player arose and
the listening habits towards music changed again. Simply said, the entire
library of CDs was transferred into a device that fit neatly in the hand.
Awesome isn’t? Where ever we travel, the
size of the MP3 player is convenient to be placed in our pocket.

Evolution of mobile music leads to
music piracy
If
we look back to the first two types of mobile music, the Walkman and the
Discman, both of these players need to be completed with tapes or CDs in order
to listening to the music that we wanted. Meaning to say, we have to buy the
tapes/cassettes or the CDs that containing the album of the groups of bands/
singers that we loved. The album (songs) that we bought whether in the shapes
of tapes or in CDs will determine the profit that will be gained by the parties
that participate in creating the album/song. In other words, we are supporting
our music industry by possessing the album in a legitimate way. Sadly, the birth
of MP3 player has brought an unbelievable change that in some points, it can be
considered as the evolution of music piracy. When Apple introduces Ipod late on,
the music industry can be seen as more apprehensive than before. The problem
that arose here is from the people themselves where they practicing illegal
download of songs. The invention of Ipod was done with all good intentions at
the first place but it became the opportunity for those who possessed the
gadget to get involves with illegitimate downloads.
The
menace is even more threatening due to the free transfer of music from one
device to another. Earlier, the Ipod and other music player such as MP3 player
needed a computer interface in order to make the transfer. But now, the devices
itself have inbuilt Bluetooth technology that later on became the worst
nightmare in which it makes the transfer easier. For the Ipod users, it has
been a boon but for the music industry, it was a disaster!
Music Piracy versus Copyright Act
Copyright is the set of exclusive rights granted
to the author or creator of an original work, including the right to copy,
distribute and adapt the work. The work in this context means the song that was
illegitimately copied (downloaded) and distributed (shared via Bluetooth) or in
other word, pirated! The advanced in technology helps to expand and increase
the possession of copyrighted opus. Tough this illegal activity was strictly
prohibited and those who practiced it, if been caught can be charged under
Copyright Act 1987 (in Malaysia), this unstoppable phenomenon keeps on running.

Hello inphiniti! Yup! The revolution of technology has actually violated the rules of copyright. This situation is uncontrollable. As Mr. Jamali said in class, technology had gone beyond us, we never can stop it, it is so hard to control.
ReplyDeleteI remembered that I used to buy the original CD of my favorite singer, Lee Hom, a male Taiwanese singer. As we know that, the original CD is very expensive. I bought the Lee Hom concert CD plus dvd cost me around Rm80++, it was really expensive! Although it was expensive, but the quality of the CD, DVD, CD cover, and the lyric book of the whole album were great! Is valuable actually.
However, new technology rise, making the market of original CD low popular, even the piracy CD also lost their market. We can access the songs and music video we want via the Internet. There are many websites provide easy way or free download for Internet users. Therefore, people who like the music video or song, they just downloaded from the internet for free. As compared to the original CD which is costing around RM60++ for an album, I believe most of the people prefer to download the album from the internet for free.
In Malaysia, I don’t think there is any strict law in handling this issue. People do not aware of the copyright issue. All people want to get what they want (benefit), with a low price (free download). The songs that on the internet are the same with the original album. So, there is no other reason for them not to download from the internet.
Throughout my 24 years of living on this very planet, I have only bought one (1) original music album. I have watched more than hundreds of movies, listened to thousands of songs, but I only bought one original music album. However, before knowing about copyright and trademark issue, I have never thought this issue as a problem. Free movies and music are so available online. Without any difficulties, we can get access to them. The downloading-culture has rooted in our lives.
ReplyDeleteMany ways can be used to solve this problem. First of all, the government should imply stricter rules or law; second, harsher punishment can be used onto the peoples. But, what really important is, letting the peoples know about the copyright and trademark issue!
Malaysia has been neglecting this very important thing in education. The exposure to such important issues is near to non-existent. I believe with sufficient information released to the public, the younger generation will learn about it, and will not download pirated musics or movies.
Besides that, I also observe that some music companies produce low cost album to attract more consumers. Also, some of them used different alternatives to share their musics with the others. Such phenomenon might not be a bad thing. It shows that the companies understand the trend right now, and are doing their best to make music and movie industries continue despite facing large losses.

ReplyDeleteSincerely, I cant live without it. The mobility of music nowadays is completing my life. As I am in my room, I turn music on. When I am walking to the class, I turn on my headphone. If I drive, my songs are on track. This is how technology comes to my life. Music is part of our lives whether we realize it or not, whether we actively contribute in it or not, whether we appreciate its power or not.
This is, in fact, the real power of music? That it can affect us whether we are conscious of it or not. Music was certainly the accompaniment to all these discoveries. In particular the singing and playing of music, helps the brain develop much more fully and extensively, especially in our early years. Music makes us brighter, more intelligent, more logical, more rational, and more capable.
However, when it comes to the music piracy and copyright, the new technology affects it. People can easily download the music for free through the internet. It gives bad impact to the music industry.

ReplyDeleteKetiga-tiga sahabat di atas sama sekali berbeza dengan sikap masyarakat di daerah saya. Limbang! Kebanyakkan penduduk di sana tidak terdedah dengan penggunaan internet dan walaupun ya, mereka masih memilih untuk membeli VCD di kedai-kedai CD. Hal ini juga menunjukkan bahawa revolusi terhadap CD muzik yang kini boleh didapati secara percuma melalui internet tidak memberi impak kepada masyarakat Limbang. Namun, apa yang harus diakui cetak rompak sangat berleluasa. Kenapa? Lebih murah dan pada segelintir masyarakat, kita tidak perlu berbelanja lebih hanya untuk mendengar muzik.
Pada saya faktor utama perkara ini terjadi ialah cinta (fanatik) terhadap artis yang diminati masih berada di tahap yang rendah. Jika kita benar-benar meminati seseorang artis tersebut maka apa saja hasil cipta yang dihasilkan oleh artis tersebut akan kita dapatkan walaupun harganya mahal. Namun, fenomena free music ini masih menjadi pilihan walaupun kita tahu perkara tersebut salah dan seolah-olah kita tidak menghargai kerja keras pemuzik dan penyanyi.
Seharusnya, terdapat satu garis panduan khas dan perlulah didedahkan kepada masyarakat tentang permasalahan ini.

ReplyDeletePerbuatan memuat turun(download) lagu mahupun video melalui internet sudah tidak asing lagi pada masa kini. Ini kerana memuat turun dari internet adalah lebih mudah dan cepat. Tambahan pula tiada sebarang cas yang dikenakan untuk memuat turun lagu mahupun video. Ini menyebabkan orang ramai semakin gemar untuk memuat turun lagu dan video melalui internet.
Namun ramai yang tidak sedar bahawa tindakan ini adalah salah di sisi undang-undang. Tindakan memuat turun lagu dan video melalui internet adalah boleh menyebabkan syarikat produksi yang menerbitkan lagu dan video tersebut muflis. Hasil seni mereka akan terjejas kerana keluaran album mereka dalam bentuk CD mahupun VCD tidak mendapat sambutan daripada orang ramai meskipun lagu mereka sangat popular. Mereka memperoleh pendapatan melalui jumlah hasil CD dan VCD mereka. Jika semua orang memuat turun melalui internet secara percuma, ini sudah pasti merugikan mereka.
Kita haruslah menghargai hasil titik peluh orang lain kerana dalam menghasilkan lagu dan video bukanlah senang dan memerlukan perbelanjaan yang besar. Dalam hal ini, pihak berkuasa harus bertanggungjawab kerana tidak melaksanakan Akta Hak Cipta 1987 dengan jayanya. Meskipun akta ini telah lama wujud namun tindakan memuat turun lagu atau video masih berleluasa malah semakin meningkat. Pelaksanaan akta ini hanya umpama melepaskan batuk di tangga. Pemantauan dari masa ke semasa haruslah dilakukan untuk mengatasi masalah ini.
Kesimpulannya, jika masalah ini tidak dibendung, sudah pasti akan menjejaskan industri seni negara. Oleh itu, bersama-sama lah kita menyokong industri seni negara dengan tidak memuat turun lagu dan video melalui internet kerana perbuatan tersebut adalah salah dan sebaliknya membeli album keluaran mereka dalam bentuk CD mahupun VCD sebagai tanda sokongan.
I think the issue of copyright for music should be taken seriously by the societies. Nowadays, people less buying original CD or DVD. They prefer to download from any sources which are free. Even myself never bought an original CD. I always view videos online or download music from Internet because it is free to be downloaded. Although I understand that the hard work of singer and peoples who involve in producing the music should be paid, there are a few reasons to explain why I never bought original CD.
ReplyDeleteFirstly, original CD are too expensive. As we know one original CD may cost us about RM 30. If we want to collect all our favorite songs with original CD, It may cost us hundreds or thousands which we as a students are definitely unaffordable to pay for it. Those people who had a lower income also may not able to buy it. Therefore, we will search for an alternative ways to get the music and we will choose to download it via online because it is free.
Besides that, the quality of the music downloaded from Internet are as good as the original CD. It is easy and convenient for people to get the music from Internet. They just have to click on their mouse and they can straight away get the music. They can avoid themselves from facing traffic jam, paying parking fees and went to a far place to get an original CD.
Moreover, people can burn the CD by themselves with vary favorite songs. Original CD only contains the songs of an artist. Some people may feel boring when they stick to an artist's songs. They had no choice to the content of the original CD. For example, if they like one of the songs in the CD, they have to buy the CD and they also need to pay for the songs which they do not really interested with. However, they can download the song which they really like only via Internet and burn into a CD with the songs they like.
So, some actions should be taken depends on the reasons why people do not like to buy the original CD. We cannot put the fault either on users or technology. People have no wrong if they are provided with free songs to be downloaded. Technology also have nothing wrong because it is controlled by peoples. Therefore, technology should be improved and people should be educated so the issues can be prevented.

ReplyDeleteSaya selama ini memang hidup dan membesar bersama-sama muzik. Manakan tidak, tidak kira apa pun yang saya lakukan, saya akan lakukan bertemankan muzik. Apabila bersedih, saya dengar muzik. Apabila saya marah, saya dengar muzik. Apabila saya gembira, saya dengar muzik. Hal ini demikian kerana bagi saya, melalui muzik, saya dapat menenangkan diri serta lebih mendalami perasaan saya. Boleh saya katakan tanpa muzik, hidup saya sangat kosong dan saya yakin agak ramai orang-orang di luar sana yang mempunyai tanggapan yang sama seperti saya.
Atas dasar-dasar tersebut, apabila pemilik lagu mengenakan bayaran yang agak tinggi untuk muzik yang dihasilkannya, hal ini menyebabkan berlakunya gejala penciplakan. Kebanyakan 'penciplak' ini tidak bermotifkan keuntungan. Hal ini lebih kepada perkongsian kerana ingin bersama-sama memiliki lagu yang terkini. Orang-orang yang 'taksub' dengan muzik-muzik terkini ini lebih gemar memuatnaik lagu dengan percuma kerana terdapat banyak lagu yang ingin dimuatnaik oleh mereka. Untuk mengelakkan bayaran yang banyak, mereka memilih untuk memuatnaik secara haram.
Namun demikian, sekiranya perbuatan memuatnaik lagu tanpa kebenaran yang boleh diakses melalui laman sesawang seperti 4shared, mp3skull dan seekasong adalah sesuatu yang salah, maka dengan itu, berani saya katakan bahawa lebih 90% daripada kita adalah penjenayah. Meskipun begitu, patutkah kita dipersalahkan? Pada pendapat saya, sekiranya sumber-sumber ini disekat, gejala ini tidak akan mendapat sambutan, sesuai dengan kata pepatah yang pernah mengatakan 'mencegah lebih baik dari mengubati'. Tepuk dada, tanya selera.

ReplyDeleteIsu memuat turun lagu serta video melalui internet sudah menjadi kebiasaan masyarakat kita zaman sekarang terutamanya golongan remaja. Hal seperti ini sangatlah memberi kesan buruk terhadap runtuhnya institusi muzik tanah air. Jika diselidiki dengan lebih mendalam, ramai dalam kalangan masyarakat kita yang bersikap mementingkan diri sendiri seperti menjual CD atau VCD cetak rompak yang bertujuan dengan harga yang jauh lebih rendah berbanding harga CD atau VCD yang asal. Hal ini mendorong kepada ramai masyarakat kita beralih arah dengan tidak membeli CD dan VCD yang asal dengan alasan harga yang diberikan terlalu tinggi. Harga CD dan VCD adalah faktor penyebab penularan pengeluaran cetak rompak (CD dan VCD) ini.
Zaman sekarang, memuat turun lagu-lagu kegemaran amat mudah. Dengan hanya menggunakan internet kita sudah dapat memuat turun dan mendengar lagu kegemaran kita tanpa ada bayaran yang dikenakan. Sebagai contoh laman sesawang seperti 4shared. Kita boleh mencari pelbagai jenis lagu di dalamnya dan memuat turun dengan kadar yang singkat serta mudah. Namun, sedarkah kita bahawa perbuatan itu sedikit mencalar reputasi industri muzik kita?
Kesimpulannya, Akta Hakcipta masih lagi tidak berkesan untuk mengekang masalah ini daripada terus berleluasa. Pemantauan secara rapi terhadap kegiatan mencetak rompak ini haruslah diketatkan lagi oleh pihak yang bertanggungjawab. Sekian
Muzik sememangnya sesuatu yang tidak dapat saya tinggalkan dalam kehidupan seharian kerana muzik adalah tempat kita mengekpresikan perasaan yang kita alami.
ReplyDeleteDalam perjalanan seni hari ini telah menyaksikan cabaran yang sangat digeruni oleh golongan seni iaitu internet. Internet merupakan satu rangkaian yang digunakan dengan meluas di seluruh dunia kerana kelajuannya yang memudahkan pengguna mendapatkan maklumat dan bahan hiburan yang mereka inginkan. Muat turun muzik melalui internet menyebabkan sesetengah syarikat rakaman menggalami kerugian besar kerana kurangnya sambutan dari pembelian Cd yang asli.
Namun, perbuatan memuat turun ini tidak dapat menyalahkan mana-mana pihak kerana internet itu sendiri memberi ruang kepada masyarakat untuk untuk mendapatkan bahan hiburan mereka. Selain itu, harga jualan CD yang asli itu sendiri menyebabkan orang ramai mengambil keputusan untuk memuat turun muzik dari internet. Keadaan ini kerana, lesen yang diberikan oleh pihak Lembaga Perfileman Malaysia yang menggeluarkan satu sticker seperti yang dilekatkan di CD yang diedarkan sangat mahal. Hal ini menyebabkan harga jualan CD yang asli sangat mahal berbanding dengan muat turun dari internet yang lebih mudah serta muzik ini juga boleh kita simpan dalam mana-mana walkman dan telefon bimbit. Oleh itu, tiada siapa pun yang boleh dipersalahkan dalam masalah ini. Akta Hak Cipta juga tidak dapat membendung masalah ini kerana teknologi canggih kini lebih menjadi pilihan masyarakat.

ReplyDeleteMemang betul jika kita lihat pada masa kini, aktiviti yang menentang hak cipta seperti pemilikian hasil seni (lagu) secara haram dan seumpamanya semakin menjadi-jadi. Zaman teknologi yang canggih menjadi pendorong kepada aktiviti hara sebegini. Walau bagaimanapun, kita tidak boleh menyalahkan individu semata-mata. Hal ini adalah kerana kita sebagai pengguna hanya menggunakan kemudahan yang telah disediakan. Dengan erti kata lain, laman sesawang ataupun aplikasi yang memudahkan kita untuk memuat turun lagu secara PERCUMA merupakan satu kemudahan yang memberi impak yang baik kepada pengguna tetapi negatif bagi mereka yang dianggap sebagai penggiat seni.
Secara peribadi, saya merupakan seorang yang selalu memuat turun lagu secara percuma melalui laman 4shared.com. Hal ini adalah kerana ia murah dan menjimatkan masa saya untuk memperolehi lagu tersebut. Memang saya sedar bahawa perkara ini merupakan satu jenayah, namun begitu, saya juga sedar bahawa ia merupakan satu peluang bagi kita sebagai pengguna untuk menggunakan kemudahan scara optimum. Jika ia betul-betul diharamkan, mengapa pihak berkuasa tidak menyekat laman-laman tersebut secara menyeluruh?
